抄録: Kandel's theory of division between interna and externa has been recognized as the framework for protection of teacher's right to educational freedom. The right is individual's freedom from control of his own state and from any intervention outside. But, educational freedom in Kandel was thought as a social right protected and promoted by the state. He thought that individual must become free existence by getteing his own group culture and mastering self-discipline. Teacher's freedom is needed only for realizing the best education for that purpose. Therefore, this freedom is restricted by the supervision system of teachers, namely teacher preparation, appraisal, promotion, and etc. by an education authority. Further, from its own nature the freedom is regulated by speciality, neutrality, professional spirit, public's will, and etc..
