EC法秩序について,これまで「連邦国家」や「国家連合」といった歴史的に前例がある統治体の理念型との対比で,その特色を論じる先行研究は多い.本稿は,しかし,(1)ECだけでなくEU全体を法秩序とみて,(2)その特徴を,前代未聞の法秩序そのものとして,理念型との対比ではない方法で探ろうとする.そのために,1983年の先行研究を紹介し,その先行研究の手法を基礎として,1990年代以降のEU法秩序形成の過程と現在の到達点を分析する.本稿はあくまでも試論であるが,暫定的な結論として,現在のEU法秩序の「動き」は,各国国民でありつつ「EU市民」でもあるヨーロッパの人々のEUおよび各国の憲法生成作用と,それと関連しつつも法的には別個の構成国政府間の条約生成作用の,両者の調和と緊張から生じているとの見方を提出する.
Numerous studies have been done to compare the EC legal order to a ""federal state"", a ""confederate state"" or an international organization, only to reach the conclusion that the EC is sui generis. These previous studies, however, deal only with a static dimension of the EC legal order, without analyzing or explaining how its dynamic character emerges. The present paper attempts to show in legal terms how the EU legal order as a whole generates the dynamism. The paper pays particular attention to F. E. Dowrick's perspective, which draws much inspiration from H .L. A. Hart's theory of legal order ; the perspective that several EC institutions or the member states compete to assert their own preferred ""rule of recognition"" (i.e., the ultimate rule that determines which laws are valid in a particular legal order) within the framework of the EU, so that constant competition between the rival rules of recognition produces new dynamics of laws at the EU level, as well as at the national level, thus constantly challenging national constitutions.
