In blocking the passage of the provision the opposing party argued that it was premature to prohibit \"\"indirect discrimination\"\" by law when the society has not reached a consensus on what was meant by \"\"indirect discrimination.\"\" Thus, a deeper analysis of the concept of \"\"indirect discrimination\"\" is called for, as it may help Japanese society understand this concept. In this article, the author first demonstrates the differences between British indirect discrimination theory and American disparate impact theory. The latter is widely known as the origin of the British indirect discrimination theory, and has been mistakenly understood as an identical theory to the former. By reconsidering how these U. S and U.
