| 内容記述 | 日本では,司法改革の一環として2004年4月から法科大学院が開設されるが,そこで行われる法曹養成教育において重要なのは,法的判断能力を養成することである.法律家が個別の事案について法的判断を行う(法的決定をくだす)場合,法に基づく裁判という枠組みの下で,それがどのようなプロセスをたどって行われるのか,また,行われるべきなのかは,近代法の歴史と共に古い論争問題であり,また,第二次大戦後の日本においても「法解釈論争」として争われ,なお論争問題としてあり続けている.「法的判断とは何か」は,判断の基準である法をどう捉えるか,つまり「法とは何か」という問題と表裏をなしており,現代の法理解の基礎に関わっている.本稿は,これに関する最近の日本の特筆すべき業績を中心にドイツおよびアメリカの議論をこれに関連させながら検討し,法的判断に関する理論状況の構図を提示するものである. | |||||

| 内容記述 | In Japan the Law Schools shall be establisched from the April 2004 as a part of the now going judicial reform of Japan. The important task of the education in the Law School schuld be the development of the talent for the legal decision. It is a great and so old issue as the modern history of law and in post-war Japan it was very strong disputed and is disputing, how do lawyers make a legal decision under the framework of statutory law. What is legal descision, it is a foundamental problem for the understanding of modern law, since it is paralell the problem, what is law. This papaer purposes to analyse the theoretical constelation about this issue with a comparing Japanese, german and american works concerned. | |||||
