| 内容記述 | Amid power struggles over global digital governance, driven by cutting-edge technologies and fueled by the surge of COVID-19, how can we safeguard a robust checking function against the abuse of power – a function typically carried out by the professional press or mass media as the Fourth Estate? / This article reviews the principle of separation of powers and institutional designs for checks and balances, mainly from the perspective of Japanese constitutional law. It also analyzes a number of problems in the current situation, such as the decline of traditional news media, the emergence of “news deserts”, and the rise of“ surveillance capitalism” in digital markets. / It further demonstrates that there is a recurring structural problem of unilateral information flow and power asymmetry not only in the mass speech markets of the twentieth century but also in the emerging twenty-first century digital milieu increasingly dominated by global online platforms and black-box algorithms. / In conclusion, this article argues that a desideratum for a future digital governance in Japan should be “separation of information powers” to transparentize and democratize the governance structure itself, by achieving a high level of diversification, decentralization, and internationalization of those who take power and those who challenge them. | |||||||||
