内容記述 | In Japan, the idea of Right to Learn was devised in post W.W.???? period, and in this process Horio Teruhisa had a vital role to play. Against his theory of Right to Learn, Freedom of Education was criticized by the reason that it doesn't make children and their parents really free. His theory fixed teacher-child relationship (or teacher-parent relationship) in one form, but it's also enforced by some of unique idea about education and law which haven't exist before. In his interpretation of Right to Learn, senses which doesn't exist on text (exist in con-text) is interpreted. In his interpretation, for example, all human rights don't need to be stipulated on a constitution because human rights are based on an action to constitute a constitution. So, force about constitution (to constitute a constitution) is key concept in his theory. Jacque Derrida said that some kind of force make legal interpretation possible for the future. In Horio's education theory, a perspective of time is important also. He explained that education have force to renewal society for the future. His legal interpretation and education theory was made by directing his attention to the future, and it might be a result of force. | |||||
