内容記述 In Twelver Shia, there is an admitted characteristic marriage system, that is, temporary marriage (mut‘ah). Temporary marriage is based on a marriage contract which decides a condition of length of marriage and bridal money, and this marriage is not permitted in Sunni.
In this article, the author will discuss the controversies in temporary marriage between Shia and Sunni, referring to Koranic exegesis, theological works, and fatwas (legal opinions) from classical times to the present day.
At first, opinions are divided between Shia and Sunni, whether marriage referred to in Koran 4:24 “those of them whom ye enjoy by means of it pay their hire as stipulated, and there will be no blame upon you in regard to anything ye may give them by mutual agreement beyond the stipulated amount” means ordinary marriage or temporary marriage. Shia scholars strongly insist that this Koranic verse means temporary marriage. On the other hand, most of Sunni scholars insist that this verse means ordinary marriage, and a few Sunni scholars says that even if this verse means temporary marriage, it was abolished by other verses, and after all, only ordinary marriage is admitted in the Islamic marriage system.
Moreover, Sunni scholars insist that many traditions of the prophet Muhammad which say that Muhammad abolished temporary marriage that was widespread in his days reinforce the prohibition of temporary marriage. There are also sayings of ‘Umar, the second caliph, which say that he abolished temporary marriage. Sunni scholars regard these traditions and sayings as reinforcement of their discussions; on the contrary, Shia scholars insist that traditions cannot abolish Koranic verses, and that they need not follow sayings of ‘Umar.
In contemporary fatwas, many questions have come from Sunni believers whether temporary marriage is allowed or not. In answers, there are quoted Koran 4:24 and traditions which say that Muhammad prohibited temporary marriage. Some scholars seem to consider that these traditions have the highest authority, and abolish the Koranic verse, even if the marriage that is referred to in Koran 4:24 means temporary marriage. In addition, in Sunni, especially Salafi, on the standpoint that temporary marriage does not exist in Islam, they tend to regard Shia as a different religion from Islam.
